Understand the Documents You Need to Submit
In order to sell your car, there are several steps you need to take. These include:
- Releasing your ownership of the car
- Obtaining a current and valid smog certificate if applicable
- Submitting an odometer statement if your car is less than 10 years old
After the sale of your car has been confirmed and you have submitted all the required documents, you need to submit a Notice of Transfer and Release of Liability Form within 5 days.
Carry Out the Necessary Inspections
Under Californian law, you need to carry out the necessary inspections before selling your car. This includes providing the new owner with a valid smog certificate when sealing the deal. You must also inform them that the certificate is only valid for 90 days after its issue. You do not need to obtain a smog certificate if:
- Your car is four years old or less.
- Your car has a model year of 1975 or older.
Transfer Ownership
To complete the sale of a car, you will need to transfer ownership to its new owner. You will require the below to finalize this step:
- A completed Certificate of Title form / Application for Duplicate or Paperless Title (REG 227). For car sellers with a missing title, you must fill in the REG 227. If you submit a REG 227, you must also get the lien holder’s signature as well as a notary to witness the signature. An exception is if your car is two model years old or less – in that case, you just get a replacement title through the lien holder.
- Your signature and that of the lien holder, if applicable
- The buyer’s signature
- Payment of a transfer fee
- If applicable, Statement to Record Ownership / Statement of Error or Erasure (REG 101) form. If any wrong information is entered on the title by mistake, you will need to submit this form to get it corrected.
- If applicable, Odometer Disclosure Statement has to be submitted. Exemptions are for vehicles 10 years or older and commercial vehicles weighing more than 16,000 pounds.
